1. Acceptance of Terms: By accessing, browsing, or using the services provided by MedicalPrivateAi ("we," "us," or "our") at medicalprivateai.com (the "Website"), you ("User," "you") expressly agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, you must immediately cease use of the Website.

2. Description of Service: MedicalPrivateAi provides a web-based, privacy-first interface for interacting with advanced artificial intelligence models. We operate strictly as an intermediary interface layer that facilitates encrypted communication between the User and the underlying AI engine, ensuring zero persistent logging of prompts or generated outputs on our infrastructure.

3. Eligibility and Access: The service is available exclusively to individuals aged 18 and older. Access to the core AI functionalities requires the purchase of a prepaid access code ("Pass"). You are responsible for maintaining the confidentiality of your Pass. We are not responsible for lost, stolen, or unauthorized use of Passes.

4. Nature of Prepaid Passes: A Pass grants a specified numerical allowance of API requests (prompts), where each submitted question deducts one (1) AI request. Passes are delivered via email and are valid for a strict period of 30 calendar days from the exact moment of activation. Upon expiration of this 30-day period, or upon exhaustion of the request allowance—whichever occurs first—the Pass and any remaining AI requests automatically expire and become permanently invalid. Unused requests do not roll over, and Passes cannot be paused, transferred, or consolidated.

5. Zero-Log Infrastructure: We do not require account creation, registration, or submission of personal identifying information to utilize the chat interface. We employ volatile session memory to facilitate active chats. Once a browser tab is closed, all session data is permanently destroyed. We retain no database records of your conversations.

6. Limitation of Liability and AI Accuracy: The AI-generated content provided through the service is delivered strictly on an "AS IS" and "AS AVAILABLE" basis. MedicalPrivateAi makes no representations or warranties, express or implied, regarding the accuracy, completeness, reliability, suitability, or factual correctness of the output. Artificial Intelligence is inherently prone to errors, hallucinations, and biases. Under no circumstances shall MedicalPrivateAi, its owners, directors, employees, or affiliates be held liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to financial loss, legal repercussions, or reputational damage, arising from your reliance on, or use of, the AI-generated output. You assume full and sole responsibility for verifying all information before applying it in personal, professional, academic, legal, medical, or financial contexts.

7. No Professional Medical Advice: Output generated by the AI does not constitute, and should never be interpreted as, professional medical, clinical, diagnostic, pharmaceutical, legal, or certified healthcare advice. You must consult qualified physicians or healthcare professionals for specific guidance, diagnosis, or treatment.

8. Prohibited Conduct: You agree to use the service only for lawful purposes. You are strictly prohibited from using the service to: (a) generate content that is illegal, defamatory, highly abusive, or promotes violence; (b) attempt to reverse engineer, decompile, or exploit the platform's infrastructure; (c) bypass or manipulate the billing or Pass authentication mechanisms; (d) deploy automated scripts, scrapers, or bots to interact with the service. Violation of these rules will result in immediate termination of the active Pass without a refund and potential blocking of your IP address.

9. Third-Party Integrations: Our service relies on third-party APIs (including OpenAI/Google) for the generation of text, and third-party gateways (Stripe) for payment processing. We do not control these third parties and are not liable for their service interruptions, downtimes, or policy changes. Our enterprise agreements with AI providers strictly prohibit the use of your prompts for model training.

10. Intellectual Property: MedicalPrivateAi claims no ownership rights over the specific text you input ("Prompts") or the exact textual output generated in response. However, the underlying codebase, platform design, algorithms, logos, and the MedicalPrivateAi brand are the exclusive intellectual property of MedicalPrivateAi and are protected by applicable copyright and trademark laws.

11. Service Availability: While we strive for maximum uptime, we do not guarantee uninterrupted access to the Website. We reserve the right to perform maintenance, updates, or modifications to the platform at any time, which may result in temporary unavailability. We are not liable for any loss of access during these periods.

12. Modification of Terms: We reserve the right to update, modify, or replace these Terms of Service at our sole discretion. Any changes will be posted on this page. Your continued use of the service following the posting of any changes constitutes acceptance of those modifications.

13. Force Majeure: MedicalPrivateAi shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, cyber-attacks on our third-party infrastructure providers, governmental actions, or widespread internet outages.

14. Indemnification: You agree to indemnify, defend, and hold harmless MedicalPrivateAi, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your violation of these Terms or your use of the AI output.

15. Severability: If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions.

16. Entire Agreement: These Terms of Service, combined with our Privacy Policy, Refund Policy, and Storage Policy, constitute the entire agreement between you and MedicalPrivateAi regarding the use of the service.

17. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any legal action, dispute, or proceeding arising out of or relating to these Terms or the use of the service shall be brought exclusively in the competent courts located in the Netherlands.

18. Dispute Resolution: Before initiating formal legal proceedings, you agree to contact us at support@medicalprivateai.com to attempt to resolve the dispute informally. European Union residents may also utilize the European Commission's Online Dispute Resolution (ODR) platform.

19. Termination: We reserve the right, at our sole discretion, to terminate or restrict your access to the service at any time, without notice or liability, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

20. Contact Information: Questions regarding these Terms of Service should be directed to our support team at support@medicalprivateai.com.

1. Introduction and Scope: This Privacy Policy governs how MedicalPrivateAi ("we," "our," or "us") processes data when you use our web application. By fundamentally designing our platform around the concept of "Zero-Log," we minimize data collection to the absolute technical minimum required for operation.

2. The Zero-Log Architecture: Our primary commitment is that we do not monitor, record, permanently store, or catalog the contents of your chat sessions. The text you input (prompts) and the text generated by the AI (responses) exist only in volatile memory during the active processing request.

3. No User Accounts Required: To maximize anonymity, we do not utilize a user account system. We do not ask for, collect, or store your name, physical address, phone number, or date of birth to access the chat interface.

4. Prompt Processing via Third-Party APIs: In order to generate intelligent responses, the text you enter must be transmitted to our underlying AI provider. This transmission is secured via an encrypted TLS/SSL tunnel. Crucially, under our enterprise API agreement, the AI provider is strictly prohibited from retaining your prompts or using your data to train, fine-tune, or improve their AI models.

5. Immediate Data Purging: Once the AI provider returns the generated response to our server, and our server forwards it to your browser, the transaction is complete. The prompt and response data are immediately purged from our active processing memory. We maintain no conversational databases.

6. Payment Data Isolation: All financial transactions, including the purchase of prepaid Passes and email delivery of your unique Pass code, are handled securely via our payment gateway partner, Stripe. Your email is never linked to your chat sessions.

7. Information We Do Log (Operational Data): To prevent abuse, enforce rate limits, and contest fraudulent payment chargebacks, we log only the following metadata: the moment of Pass code generation, the moment of Pass code activation, and a numerical tally of how many requests a specific Pass code has consumed. This data is not linked to your chat content.

8. IP Address Handling: While server logs temporarily process IP addresses to route traffic and defend against DDoS attacks, we do not permanently store IP addresses, nor do we map IP addresses to specific chat prompts or Pass codes. Log files containing raw connection data are routinely rotated and overwritten.

9. No Third-Party Tracking: We do not sell, rent, or trade your data. Furthermore, we do not embed third-party advertising trackers, social media pixels, or behavioral analytics tools on the chat interface that could monitor your activity across other websites.

10. Data Security Measures: We employ industry-standard security measures, including End-to-End Encryption in transit (HTTPS/WSS) and robust server-side security protocols, to protect the fleeting data during transmission. The front-end interface includes mechanisms to deter casual local inspection (such as disabling developer tools).

11. International Data Transfers: By using our service, you acknowledge that your prompts are processed by servers that may be located outside of your country of residence, including in the United States. We ensure that our third-party data processors adhere to rigorous data protection standards equivalent to the GDPR.

12. User Rights under GDPR: The General Data Protection Regulation (GDPR) grants European users rights to access, rectify, port, and delete their personal data. However, because our architecture is entirely stateless and zero-log, it is technically impossible for us to fulfill requests to access, modify, or delete chat histories, as we do not possess them.

13. Data Breaches: In the highly unlikely event of a server compromise, the risk to user privacy is structurally mitigated by the fact that no historical chat databases exist to be stolen.

14. Compliance with Law Enforcement: If compelled by a valid legal subpoena or court order, we will comply with law enforcement. However, because we do not log chat content or map users to IP addresses, we cannot provide conversational histories or identifying user profiles that we do not possess.

15. Children's Privacy: Our service is strictly intended for users 18 years of age or older. We do not knowingly collect or process any data from children under the age of 18.

16. Automated Decision Making: We do not use your data for automated profiling or decision-making that produces legal effects concerning you.

17. Retention Policy: The metadata regarding Pass usage (activation time and request counts) is retained only for a maximum of 12 months after the Pass expires, solely for financial auditing and dispute resolution purposes.

18. Changes to this Policy: We reserve the right to modify this Privacy Policy. Any substantial changes will be communicated by updating the effective date on this page. Your continued use of the service constitutes acceptance of the revised policy.

19. Contact for Privacy Inquiries: If you have any questions, concerns, or requests regarding our data processing practices, please contact our Data Protection representative at support@medicalprivateai.com.

20. Right to Complain: If you believe our processing of data violates data protection laws, you have the right to lodge a complaint with your national supervisory authority (e.g., the Autoriteit Persoonsgegevens in the Netherlands).

1. Classification of Service: MedicalPrivateAi provides prepaid access codes ("Passes") that grant immediate access to a digital service (Artificial Intelligence processing). These Passes are classified legally as digital content not supplied on a tangible medium.

2. Immediate Fulfillment: Upon successful processing of your payment, the digital Pass code is generated and delivered instantly on your screen and via email, allowing immediate access to the AI interface.

3. Statutory Right of Withdrawal (EU Consumers): Under the European Union Consumer Rights Directive (Directive 2011/83/EU), consumers typically have a 14-day right of withdrawal for online purchases. However, there are specific exemptions for digital content.

4. Digital Goods Exemption Application: In accordance with Article 16(m) of the aforementioned Directive, the right of withdrawal does not apply to the supply of digital content if the performance has begun with the consumer's prior express consent and their acknowledgment that they thereby lose their right of withdrawal.

5. Express Consent: By initiating a purchase, completing the checkout process, and receiving your Pass code, you explicitly consent to the immediate performance of the contract and acknowledge that you lose your statutory right of withdrawal.

6. Non-Refundable Nature: Because of the immediate delivery, the anonymous nature of the service, and the upfront costs incurred by us to reserve API capacity, all sales of Passes are final. We do not offer refunds, partial refunds, or prorated credits under any circumstances once a Pass has been delivered.

7. No Refunds for Unused Requests (30-Day Expiration): A Pass provides a specific allowance of AI requests. For security reasons, all Passes are strictly valid for a period of 30 calendar days. If you do not use all your allotted requests within this 30-day validity period, the remaining requests expire completely. No refunds will be provided for unused, expired requests.

8. No Refunds for Dissatisfaction: Due to the unpredictable nature of Artificial Intelligence, we do not offer refunds if you are dissatisfied with the quality, accuracy, style, or factual correctness of the generated output. The service is provided "AS IS."

9. No Refunds for Account Bans: If your access is terminated because our automated systems detect severe violations of our Terms of Service (e.g., generating illegal content, automated scraping, or abuse of the infrastructure), your Pass will be invalidated without refund.

10. Technical Failures on Our End: In the rare event of a severe, documented, and prolonged infrastructure failure on our end that renders the service completely inaccessible for an extended period, we may, at our sole discretion, offer a replacement Pass or a deadline extension, but we are not legally obligated to provide a monetary refund.

11. Third-Party Outages: We do not offer refunds for temporary downtime caused by third-party providers (such as OpenAI/Google API outages or Vercel server issues).

12. Incorrect Purchases: It is your responsibility to select the correct Pass tier during checkout. We do not refund, downgrade, or upgrade Passes after a transaction is complete.

13. Lost Pass Codes: Please keep your confirmation email safe. We do not issue refunds for lost codes.

14. Stolen Pass Codes: You are responsible for the security of your Pass code. We will not issue a refund or a replacement if your code is intercepted, shared, or used by an unauthorized third party.

15. Fraudulent Chargebacks: Initiating a chargeback or dispute via your bank, credit card company, or Stripe after receiving a valid Pass is considered friendly fraud and a breach of this contract.

16. Chargeback Defense: In the event of a chargeback, we will present these Terms and the timestamp logs proving the generation and delivery of the Pass code to the payment processor to aggressively contest the dispute.

17. Consequences of Disputes: Any Pass code associated with an active payment dispute or chargeback will be immediately and permanently disabled, regardless of the remaining request balance.

18. Future Service Bans: Users who initiate fraudulent chargebacks may have their IP addresses permanently banned from accessing MedicalPrivateAi in the future.

19. Payment Gateway Policies: All transactions are also subject to the terms and conditions of our payment processor, Stripe. We are not responsible for any fees or holds placed by your banking institution.

20. Contact for Billing Issues: If you experience a genuine technical error during checkout (e.g., being charged twice due to a system glitch), please contact support@medicalprivateai.com immediately with your transaction ID so we can investigate.

1. Policy Overview: This Storage Policy explains how MedicalPrivateAi uses local browser storage mechanisms. Because we are fundamentally opposed to user tracking, our approach to browser storage is exceptionally strict and minimal.

2. Absolute Ban on Tracking Cookies: We do NOT use traditional persistent cookies. There are no advertising cookies, no marketing pixels, no cross-site trackers, and no behavioral analytics scripts running on our platform.

3. Use of Volatile Session Storage: To ensure the application functions smoothly without requiring a login system, we rely exclusively on a browser mechanism called "sessionStorage" (Volatile Temporary Memory).

4. Purpose of Temporary Memory: This temporary memory is strictly utilized for two functional purposes: (a) securely holding your active Pass code in memory so you do not have to retype it for every single prompt, and (b) counting the number of prompts used within the free tier. Your actual questions and answers are NEVER stored in sessionStorage.

5. Ephemeral Lifespan: Data stored in `sessionStorage` is fundamentally tied to the lifecycle of your current browser tab. The moment you close the tab or window, the operating system automatically and permanently deletes this data.

6. Protection Against Local Snoopers: By explicitly avoiding `localStorage` (which survives tab closures), we protect your privacy against individuals who might physically access your computer or open your browser after you have left.

7. No Server-Side Syncing: The data held in your browser's temporary memory is never synced back to our servers to create a profile. It remains entirely local to your device.

8. Exemption from Active Consent: Under the EU ePrivacy Directive (the "Cookie Law") and GDPR guidelines, tracking cookies require explicit opt-in consent. However, storage mechanisms that are "strictly necessary for the delivery of a service requested by the user" are exempt from requiring active consent.

9. Classification as Strictly Necessary: Because maintaining session continuity (remembering your authentication Pass) is the core technical requirement for providing the chat service you requested, our use of temporary memory is legally classified as strictly necessary.

10. Clean Interface Principle: Because we strictly use exempt, non-tracking volatile memory, we keep the interface free of intrusive tracking banners.

11. Third-Party Embedded Content: We do not host third-party widgets (like social media sharing buttons or external comment systems) that could bypass our strict policies and inject their own tracking cookies.

12. Browser-Level Controls: You have full control over your browser's storage. You can configure your browser to block all storage mechanisms, but please note that the MedicalPrivateAi service will not function if `sessionStorage` is disabled, as we cannot authenticate your requests.

13. Incognito / Private Browsing: We highly recommend using MedicalPrivateAi in "Incognito" or "Private Browsing" mode. These modes enforce even stricter memory management and guarantee that no residual cache is left on your hard drive by the browser itself.

14. No Fallback to LocalStorage: Our codebase is strictly designed to fail rather than fall back to persistent `localStorage` methods, ensuring our privacy promise is never technically compromised.

15. Auditing and Review: We regularly audit our front-end code dependencies to ensure that no third-party libraries we use are silently introducing unapproved storage methods.

16. Do Not Track (DNT) Signals: While we respect the concept of DNT browser signals, they are irrelevant to our platform, as we inherently do not track any users by default.

17. Zero Chat History Storage: We never write any prompt text or AI response text to `sessionStorage` or `localStorage`.

18. Local Chat History Rendering: The history of the chat you see on your screen is rendered purely via the Document Object Model (DOM) and memory arrays tied to the active session. If you refresh the page, the chat history disappears entirely.

19. Updates to Storage Protocols: If modern web standards introduce even more secure or volatile storage APIs in the future, we commit to migrating to them to enhance local privacy further.

20. Inquiry Protocol: For detailed technical questions regarding how our front-end handles memory and storage, you may contact our engineering lead via support@medicalprivateai.com.

MedicalPrivateAi is committed to providing a secure and reliable service. If you encounter any technical issues with your pass or have general inquiries, please contact our support team.
